1. Acceptance of Terms
By accessing or using the TakeTitle platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
TakeTitle Inc. ("TakeTitle," "we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Platform following any changes constitutes acceptance of those changes.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.
Certain investment opportunities on the Platform may be limited to accredited investors as defined by applicable securities laws. You agree to provide accurate information regarding your investor status and financial qualifications.
3. Account Registration
To access certain features of the Platform, you must create an account and complete our identity verification process (KYC/AML). You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
4. Investment Risks
Investments in tokenized assets involve significant risks, including but not limited to:
- Loss of principal investment
- Illiquidity and limited secondary market
- Regulatory uncertainty
- Technology and cybersecurity risks
- Asset valuation fluctuations
You should only invest money you can afford to lose. Past performance is not indicative of future results.
5. Fees
TakeTitle charges fees for certain services, including but not limited to platform fees, transaction fees, and management fees. All applicable fees will be disclosed prior to any transaction. Fees are subject to change with notice.
6. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of TakeTitle or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKETITLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY INVESTMENT MADE THROUGH THE PLATFORM.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
